Terms and conditions of service
The following are the terms and conditions for the use of the sms-activation-service.com service (hereinafter referred to as "SMS SERVICE" or "Service") by the Customer (hereinafter referred to as "Customer" or "User"). Please read them carefully.
This Public Offer https://sms-activation-service.com/ (hereinafter referred to as the Offer) is an official offer by SMS SERVICE to the User to enter into an Agreement for the provision of mediation and technical services on the terms and conditions set forth below.
Conclusion of the Contract for provision of mediation and technical services between SMS SERVICE and the User shall take place by acceptance of the offer. Acceptance of the offer shall take place in the manner specified in the Offer. By accepting the Offer, the User guarantees that he/she has fully familiarized himself/herself with the terms and conditions of the Offer and the service agreement concluded in accordance with the Offer.
PREAMBLE.
The conclusion of the Agreement as a result of the Offer acceptance can be made by Users from different countries, subject to the limitations established by the Offer.

A contract concluded between SMS SERVICE and the User as a result of the User's acceptance of the Offer. The contract shall be concluded on the terms and conditions specified in the Offer. |

Completion of actions specified in the Offer by the User on acceptance of the Offer in full. Acceptance of the Offer is full and unconditional. As a result of Acceptance of the Offer, a contract for provision of SMS SERVICE Services in favor of the User shall be deemed to have been concluded. |

1. SUBJECT OF THE OFFER
1.1 This Offer regulates the procedure for concluding the Agreement and rendering the Services.
2. MODIFICATION OF THE OFFER
2.1 SMS SERVICE shall have the right to amend the text of the Offer, including amendments to the Agreement, at its discretion and at any time.
2.2 SMS SERVICE shall publish the amended version of the Offer immediately after the changes have been made. The User undertakes at his own risk to regularly check for changes in the Offer (but at least once every 14 days), and bears all risks of violating the amended terms and conditions of the Offer and the Agreement.
3. ACCEPTANCE OF THE OFFER
3.1 Acceptance of the Offer is performed by the User by performing the following actions:
3.1.1 The User ticks the box "I have read and agree with the terms and conditions of the Public Offer" when going through the Registration procedure. sms-activation-service.com”.
3.2 By accepting the Offer, the User warrants that:
3.2.1. has reached the age of 18 years (as well as the age of majority in the country of his residence), and that there are no any circumstances that prevent the User to fulfill his obligations under the Offer, the Agreement in full.
3.2.2. the legislation of the User's country of residence allows to conclude the Contract, order the Services and receive the result of the Services. If the conclusion of the Contract is prohibited by the personal applicable law of the User, such User has no right to conclude the Contract and is obliged to leave the Website immediately.
3.2.3. has fully familiarized with the text of the Offer and understands its terms and conditions.
3.2.4. the Acceptance of the Offer is full and unconditional. Partial Acceptance of the Offer, Acceptance of the Offer "under the condition" is not allowed.
3.2.5. is aware of his right to make proposals to the Offer, the Contract concluded as a result of the Acceptance of the Offer, by sending such proposals to SMS SERVICE e-mail specified in the Offer; and that after the Acceptance of the Offer the User is considered to have exercised such right, and that subsequently the User does not have the ability to propose changes to the Offer, the Contract.
3.3 The User is not entitled to accept the Offer, conclude the Agreement, order the Services and receive the result of the Services, if the User does not comply with all the above guarantees.
3.3.1 If at the time of Acceptance of the Offer the User complied with all the above guarantees, but in the course of execution of the Agreement the User ceases to comply with one or more of the above guarantees, the User shall immediately stop using the Website, ordering and receiving the result of the Services, and immediately notify SMS SERVICE thereof. Thereafter, such User shall be obliged to act in accordance with the instructions received from SMS SERVICE, and SMS SERVICE shall be entitled to delete the Account of such User and terminate the concluded Agreement immediately.
4. REGISTRATION PROCEDURE
4.1 To order and receive the result of the Services, the User must create a Personal Account. The Personal Account becomes available to the User after passing the Registration procedure.
4.2 Procedure of Registration.
4.2.1 To complete the Registration procedure, the User must follow the link: https://sms-activation-service.com/registration. The link may differ depending on the language chosen by the User (for example, to complete the Registration in English, the link will look as follows:sms-activation-service.com/en/registration/.
4.2.2 Using the functionality of the Website, the User enters the Registration data and confirms the entered password.
4.2.2.1 By entering the Registration Data, the User warrants that:
4.2.2.1.1. the entered Registration Data will be complete and true.
4.2.2.1.2. The User is and will be the sole owner and rightful owner of the e-mail address (E-mail). Entering someone else's e-mail address is not allowed.
4.2.2.1.3. understands that all actions performed with the use of the entered e-mail address are considered to be performed by him/herself, and the User bears all risks for compliance with this warranty. If the User loses possession of the e-mail address, the User undertakes to notify SMS SERVICE immediately.
4.2.2.1.4. is aware of the need to observe proper security measures in order to prevent third parties from accessing the e-mail.
4.2.2.2 After entering the Registration Data, the User is obliged to fully read and agree to the terms and conditions of this Offer and the Policy on Processing Personal Data and Cookies by ticking the appropriate checkbox.
4.2.2.3. The last step of the Registration is to confirm the Registration procedure by clicking on the following link https://sms-activation-service.com/en/home/ .
4.2.2.4. After clicking on the sent link, the Registration is considered successful and the User is assigned a Personal Account. The User gets access to the Personal Account by entering the Authorization Data.
4.3 SMS SERVICE has the right to refuse the User's Registration in the following cases:
4.3.1 SMS SERVICE has reason to believe that:
4.3.1.1. that the Registration Data entered by the User is unreliable;
4.3.1.2. that the use of the Website is or will be carried out by the User in breach of the provided guarantees (including the guarantee of compliance with legal requirements);
4.3.1.3. that the User, at the discretion of SMS SERVICE, has committed acts that harm or may harm the reputation of SMS SERVICE.
4.4. SMS SERVICE shall have the right to cancel a Registration that has already been made, regardless of the term of such Registration. Cancellation of the Registration shall take place in the same cases as denial of the Registration.
5. SUBJECT MATTER OF THE CONTRACT TO BE CONCLUDED
5.1 In accordance with the Agreement, the User shall have the opportunity to order SMS SERVICE's Services of providing a technical opportunity to familiarize themselves with the text of SMS received at the number to be used, for which the User shall pay SMS SERVICE a fee.
5.2 By providing the Services, SMS SERVICE shall act as an intermediary between the User and the cellular network operator.
5.3 The term and Tariffs for rendering the Services are posted on the Website.
5.4 The Services may be provided using the API of the Service.
6. CONTRACT VALIDITY PERIOD
6.1 The Agreement shall be deemed concluded from the moment of Acceptance of the Offer and until the Parties fulfill their obligations under the Agreement or delete myAlpari.
7. TERMS OF SERVICE
7.1 The Services are rendered under the terms and conditions of the Agreement.
7.1.1 The User shall be guided by the information on the Website in everything that is not stipulated by the Agreement. Such information is recognized as an integral part of the Agreement. In case of contradictions, the information on the Website shall prevail.
8. PERSONAL CABINET
8.1 After Registration, the User has access to the Personal Account.
8.2 Ordering Services and receiving the result of the Services is carried out using the functionality of myAlpari.
8.3 SMS SERVICE has the right to suspend the User's access to myAlpari in the following cases:
8.3.1. SMS SERVICE has detected indications that the User's Registration has been canceled.
8.3.2 SMS SERVICE has detected suspicious attempts to enter Authorization Data (unauthorized access to the Personal Account).
8.3.3 SMS SERVICE has received a request from a competent authority and/or person regarding the User's activities.
8.3.4. On other grounds at the discretion of SMS SERVICE.
8.4 If access to the User's Personal Account is suspended, the following consequences shall occur:
8.4.1 The User temporarily loses the ability to access the Personal Account by entering Authorization Data.
8.4.2 The User has the right to submit a request to SMS SERVICE by e-mail regarding the restoration of access to the Personal Account.
8.4.3 Based on a request received from the User, SMS SERVICE shall send a request for information to the User.
8.4.3.1 A request for information may be sent by SMS SERVICE on its own initiative. In any case, the User is obliged to act in accordance with the requirements of SMS SERVICE contained in the request.
8.4.4 If SMS SERVICE complies with all SMS SERVICE requirements and SMS SERVICE has no other grounds for suspending access to the User's Personal Account, SMS SERVICE shall restore access to the User's Personal Account.
8.5 SMS SERVICE has the right to irrevocably delete the User's Personal Account in the following cases:
8.5.1 Upon the User's request by e-mail.
8.5.2 If the reasons for suspension of access to the Personal Account have not been eliminated by the User within 30 (Thirty) days from the date of SMS SERVICE.
8.6 If the User's Personal Account is deleted, the following consequences will occur:
8.6.1. the User permanently loses the ability to access the Personal Account by entering Authorization Data.
8.6.1.1 SMS SERVICE shall have the right to store information about all actions performed by the User using the functionality of myAlpari on the terms and conditions of the Personal Data Processing Policy and cookie files.
8.6.2 The User's balance shall be refunded in accordance with the rules of the relevant section of the Agreement.
9. REMUNERATION SMS SERVICE
9.1 The User shall pay SMS SERVICE remuneration for the provision of the Services. The amount of remuneration shall be set forth in the Tariffs.
9.2 The remuneration shall be paid through the payment methods available on the Website.
9.3 The deposited funds shall be displayed in the "Balance" (or analog) section of the User's Personal Area and shall be reduced when ordering Services. If the deposit is exhausted, it is impossible to order new Services.
9.4 The debiting of funds from the Balance shall take place as follows:
9.4.1. the User selects the Used number for SMS Reception;
9.4.2. the User's balance is reduced by the cost of the Service;
9.4.3. the User is given an opportunity to Receive SMS from the Used Number.
9.5. The User's Personal Account maintenance fee is charged starting from the 3rd (Third) month after Registration and amounts to 50 (Fifty) rubles of the Russian Federation per month. If the User's Balance is positive, SMS SERVICE may unilaterally reduce the User's Balance on a monthly basis by the amount of SMS SERVICE's fee for maintenance of the Personal Account.
9.6. SMS SERVICE may decide to grant a personal discount to the User or completely release the User from the obligation to pay for the maintenance of the Personal Account.4
10. PAYMENT SECURITY
10.1 When replenishing the Balance by bank card, payment processing (including entering the card number) takes place on a secure page of a processing system that has passed international certification. Payment security is guaranteed by the processing center. This means that the User's confidential data (card details, registration data, etc.) are not received by SMS SERVICE, their processing is fully protected and no one, including SMS SERVICE, can obtain the User's bank card details or other data necessary for making a payment.
10.2 When working with card data, the Payment Card Industry Data Security Standard (PCI DSS) developed by Visa and MasterCard international payment systems is applied, which ensures safe processing of the User's bank card details. The applied technology of data transmission guarantees security of transactions with bank cards by using TLS (Transport Layer Security), Verified by Visa, Secure Code, MIR Accept and closed banking networks with the highest degree of protection.
11. MONEY REFUND
11.1 The User shall be refunded by SMS SERVICE in the following order:
11.1.1 The User shall send an application for the refund operation to SMS SERVICE's e-mail;
11.1.2. SMS SERVICE shall examine the application within 5 working days;
11.1.3. If the Service has not been rendered or has been rendered improperly, SMS SERVICE shall offer options for correction of the Service, if the reason for the return operation is the failure to render or inoperability of the Service;
11.1.4. SMS SERVICE shall determine the amount of refund based on debiting operations from the User's Personal Area Balance;
11.1.5. SMS SERVICE shall perform the refund operation exclusively using the User's details that the User entered when making the payment.
12. APPLICABLE LAW AND DISPUTE RESOLUTION
12.1 Applicable law to the Parties' relations under the Contract: Singapore law.
12.2 The claim procedure of dispute resolution under the Contract is obligatory for the Parties. The term of claim consideration is 60 (Sixty) calendar days from the date of receipt of the claim. The proper procedure for submitting a claim shall be the submission of a duly executed and signed by an authorized person claim in writing by registered mail to the address of the Party specified in the Offer (for SMS SERVICE), or to the e-mail provided during Registration (for the User).
12.3 If the Parties fail to reach a pre-trial agreement on dispute settlement, the dispute shall be submitted for resolution to a competent court in accordance with the laws of Singapore.
13. LIABILITY OF THE PARTIES
13.1 Unless otherwise provided for in the Offer, the User acknowledges and agrees that the Site for the purpose of providing the Services is provided to the User "AS IS" and "AS AVAILABLE", without any warranties of any kind, including those regarding commercial value, fitness for a particular purpose, continuous availability, etc. SMS SERVICE does not warrant that the Site will be error-free, that its functionality will meet the User's expectations, or that it will be free of defects, viruses or other harmful components.
13.2 In no event shall SMS SERVICE be liable for direct, indirect or consequential damages or losses of any kind (including, but not limited to, loss of revenue or profit, or use of data).
13.3 The User undertakes to:
13.3.1 Compensate SMS SERVICE for losses caused by payments collected from SMS SERVICE by third parties, including administrative fines by control and supervisory authorities, received by SMS SERVICE due to violations by the User of the provisions of the Agreement and the law.
14. INTELLECTUAL PROPERTY
14.1 The exclusive rights to the Site, any of its contents, belong to SMS SERVICE, or its contractors, all rights to these objects are protected.
14.2 The User may not perform any actions with the Site and its contents, except for ordering Services and receiving the result of the Services.
15. FINAL PROVISIONS
15.1 In the event that certain provisions of the Offer cannot be applied to the specified extent due to legal restrictions, they shall be replaced by provisions that are as close as possible in their meaning to the original ones, and shall be applied in the modified form (including to already established legal relations).15.2 Recognition of invalidity in whole or in part of one or more provisions of the Offer shall not entail invalidity of other provisions of the Offer, or the Offer or the Agreement as a whole.
